Welcome to nosh Beauty. These Terms & Conditions ("Terms") govern your access to and use of noshbeauty.com (the "Site") and any products, content, or services offered by nosh Beauty LLC ("nosh Beauty," "we," "us," or "our"). By visiting the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. If you're using the Site on behalf of someone else, you're confirming you have the authority to bind them to these Terms.

2. Products & Descriptions

We do our best to accurately describe and photograph our products, including The Schmear and every shade and formula we offer. Colors may vary slightly depending on your screen. We reserve the right to limit quantities, discontinue products, or correct errors in product descriptions, pricing, or availability at any time, even after an order has been placed.

3. Pricing & Payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or unavailable inventory. Payment is processed securely through our third-party payment processor(s) at checkout; we do not store your full card details.

4. Orders & Shipping

Order processing and shipping timelines, carriers, and rates are listed on our Shipping & Returns page. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. We are not responsible for delays caused by the carrier, customs, or events outside our control.

5. Returns & Refunds

Our return and refund policy is set out on our Shipping & Returns page. That policy is incorporated into these Terms by reference, please review it before purchasing.

6. Promotions, Gift Cards & Discount Codes

Gift cards and discount codes are subject to any additional terms stated at the time of issuance, are not redeemable for cash except where required by law, and may not be combined unless we say otherwise.

7. Intellectual Property

All content on the Site, including the nosh Beauty name, logo, product names (like The Schmear and Yenta), photography, copy, and design, is owned by or licensed to us and protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.

8. User Conduct

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to our systems; interfere with the Site's operation; scrape or harvest data from the Site; or submit false or misleading information (including in reviews or account details).

9. User-Generated Content

If you submit reviews, photos, comments, or other content to us (including via social media tags or email), you grant nosh Beauty a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, and display that content in connection with our business and marketing. You're responsible for making sure you have the rights to anything you submit.

The Site may link to third-party websites we don't control. We're not responsible for the content, policies, or practices of any third-party site.

11. Disclaimer of Warranties

The Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Product descriptions (including claims like vegan, cruelty-free, or dermatologist-reviewed) are provided for informational purposes; individual results and skin reactions can vary, and we recommend a patch test before full use. If you have a known allergy or sensitivity, review the ingredient list before purchasing.

12. Limitation of Liability

To the fullest extent permitted by law, nosh Beauty and its officers, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

You agree to indemnify and hold nosh Beauty harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Hudson County, New Jersey, and you consent to their jurisdiction.

We may update these Terms at any time. Changes take effect when posted to this page, so please check back periodically. Continued use of the Site after changes means you accept the updated Terms.
